Re-regulating Zero Hours Contracts: 

A New IER Publication


 


 

Dear IER Supporter,

With a ban on exclusivity clauses included in the Small Business, Enterprise
and Employment Bill, and a consultation on how to prevent employers from
avoiding it, the regulation of Zero Hours Contracts has been in the news.
However, the abolition of exclusivity clauses is a red-herring. This
superficial reform will do little to amend the exploitation of workers on
ZHCs, argue Simon Deakin and Zoe Adams in

Re-Regulating Zero Hours Contracts a new publication from IER.

Zero hours contracts are highly profitable for employers, but lead to
insecurity of income, and low pay for workers.  

The authors argue that the rise of ZHCs is largely the result of deliberate
policy decisions that have undermined the standard employment contract and
allowed precarious work to spread. Tax law, the legal framework of public
procurement, and social security all reinforce the employment law which
encourages the proliferation of ZHCs.

As such the debate desperately needs to move beyond exclusivity contracts.
The authors propose several reforms based on European examples, including:

*	A change in the statutory definition of continuity
*	A right to regular work and income
*	An end to using the social security and tax systems to subsidise
low-hours employment.
*	A revision of the public procurement process
*	A new role for collective bargaining
