As MPs voted to give May's government authority to trigger Article 50, thoughts are turning to what a post-EU UK could look like.
The IER argues that a post-EU UK should go beyond protecting the workers' rights we have now to build a stronger framework of law that would promote higher wages and conditions, and less inequality. Our recommendations, which have been adopted by the Labour Party, are set out by 15 leading labour lawyers and academics in our Manifesto for Labour Law <http://ier.us12.list-manage.com/track/click?u=f121e48a8bb6d3101590c12d3&id=3517a91737&e=71131c031b> .
Our key proposal is to shift the focus of labour law from statutory minimum rights to collective bargaining, allowing workers to organise and negotiate for higher wages and conditions within not only their companies but across entire sectors. With greater spending power, demand for products and services will increase, leading businesses to create new jobs.
We also recommend that everybody in employment is eligible for the same statutory rights - which would be stronger than they are today - in order that companies cannot exploit vulnerable sections of society (such as agency workers, who currently have fewer rights than employees; and those who are misclassified as "self employed").
In addition, our policies ensure there are repercussions for those who break the rules. We propose having agreeing dispute procedures collectively so most problems can be resolved without going to court, labour inspectors within workplaces to make sure the law is followed, and free at the point of use tribunals.

If govt wants older people to stay in work, it needs to improve their rights
The government yesterday announced a new strategy to "encourage the over 50s to reap the benefits of work" – a phrasing that seems to place responsibility on the unemployed for their own bad luck – at a time when it is systematically undermining the very mechanisms that could help older workers fight for their rights.

Govt says workers only "discouraged" not "prevented" from accessing justice
Despite a 68% fall in cases between 2013 and 2015, the government insists that workers are not "prevented" from accessing justice, they are only "discouraged".
