The future of labour law: progressive rights under a progressive government
For decades, the Institute of Employment Rights has recommended a shift in the focus of labour law from individual to collective rights, thereby redressing the inherent imbalance of power between employers and workers – a key driver of income inequality. Although this progressive approach has been adopted in some of Europe's strongest economies, in the UK, neoliberal reforms made under the Thatcher government have been accepted as the status quo and either built upon or worked within by successive governments – Conservative and Labour. As a result, collective bargaining coverage in the UK has fallen to just 29% compared with the European average of 60%, and the UK is now the most unequal country in Europe in terms of wage inequality.
The swell of grassroots support for Jeremy Corbyn has revealed a hunger among workers for an alternative to neoliberalism, which the Labour Party promised to deliver in its popular 2017 Manifesto For the Many, Not the Few. The 20-point plan on workers' rights put forth as part of that campaign was heavily influenced by the IER's Manifesto for Labour Law – 25 recommendations for reform drafted by 15 leading labour lawyers and academics. Shadow Chancellor John McDonnell has confirmed that the IER's proposals will form the blueprint for the Labour Party's labour law reform.
Since it was published in 2016, our team of experts has continued working on the Manifesto for Labour Law project, preparing our recommendations for their translation into draft legislation. At this conference, key authors from our Manifesto team will guide delegates through our proposed reforms, the evidence behind them, and the benefits for workers, employers and the economy of reform.
