Over one in ten insecure workers get less than 24 hours' notice of shifts

More than one in ten people in insecure employment are given less than 24 hours’ notice of the hours they will be expected to work, and most are given less than four weeks'.

 <https://www.ier.org.uk/news/more-than-one-in-ten-insecure-workers-given-less-than-one-day-notice/> N <https://www.ier.org.uk/news/more-than-one-in-ten-insecure-workers-given-less-than-one-day-notice/> ew figures from the Living Wage Foundation also revealed that over two in five workers (42%) had shifts cancelled at short notice, of which most (90%) did not receive full pay, and 28% of which were not paid at all.

For more than a third (35%) of these workers, the volatility of work caused financial strain, 40% felt less able to plan their work and personal lives, and a quarter were forced to pay out more on childcare or travel due to being called in at short notice.

Graham Griffiths, Director of the Living Wage Foundation, said: "There is a real danger that as we look to recover from the huge damage of the pandemic, we fail to recognise the vital need for an economy built on jobs with decent pay and secure hours. This is what we need for a modern, dynamic economy that delivers stability to workers, families and businesses.”

Lord John Hendy QC's new  <https://www.ier.org.uk/press-releases/new-bill-will-abolish-insecure-work/> Status of Workers Bill seeks to answer that call by replacing the UK’s overcomplicated three-tier employment status system with a universal status of ‘worker’. This would ensure that all people in employment have equal access to workers’ rights, effectively abolishing insecure work by providing insecure workers with the power to negotiate with their employers without fear of dismissal.

Our Labour Law Highlights publication takes a stroll through the main judicial and statutory highlights of the previous year. In this case, the year under review will be for ever remembered as the Covid year.

The public health crisis and the ensuing lockdowns go someway to explaining the relative brevity of this year’s report: politicians were focused on the pandemic and keeping the economy turning, while the number of court cases was substantially reduced as courts – like many workplaces – adjusted to working on-line.

Covid-19 also helped expose some of the fundamental weaknesses in the UK’s employment law and our authors turn their legal eyes to a range of these issues including industrial action, redundancy, TUPE, whistleblowing and equalities.

Of particular interest this year is the question of the employment status of workers in the gig economy. Issues reflected upon include the exclusion of gig workers from the job retention scheme (furlough), whether gig workers should be covered by health and safety protections and, in a case that went all the way up to the Supreme Court, how the definition of ‘worker’ should be determined, the outcome of which decides who is entitled to the minimum wage, paid holidays and rest breaks.
