Lord John Hendy QC, IER Chair, warned the House of Lords on Tuesday (14 September 2021) that <https://www.ier.org.uk/news/policing-bill-will-extinguish-right-to-strike-in-public-services/> the Police, Crime, Sentencing and Courts Bill could "extinguish" the right to strike for public sector workers.
The Bill currently allows the Secretary of State to unilaterally define key phrases in the legislation, including "serious disruption to the life of the community".
Should police officers believe a protestor - or a group of protestors - to be guilty of such an offence, they would be permitted to take action.
Draft Regulations have been published defining the phrase very broadly in such a way as to encapsulate the lawful picketing of public services, Lord Hendy warned. Because the Regulations are secondary legislation, they will receive no meaningful debate in Parliament and cannot be amended through the democratic process.
"Surely this is an abuse of parliamentary democracy,” he told the Lords.
“Let us have the debate on the basis of meanings set out on the face of the Bill, not ones yet to be determined and then tucked away in secondary legislation, which avoids all but cursory parliamentary scrutiny and which we cannot amend. I ask the Minister to amend the Bill by including in it the definitions which she desires.”
