John Hendy QC's Response to Vince Cable's threats for more restrictions on
unions


 


johnhendy_0_img_assist_custom.pngIn June 2011 Vince Cable addressed the GMB
Congress in Brighton. Cable used that platform to warn trade unionists of
the Government's plans to reduce access to justice for workers (unfair
dismissal and ET changes) and to restrict still further the right to strike
should strike activity increase. That  morning the President and Chairman of

Not so Nice  <http://www.ier.org.uk/node/808> NISA - UK recognition laws
need amending to prevent Wapping bad practices.

In 2001 IER called for a change in the UK's recognition laws to prevent
sweetheart unions being used to block applications from independent unions.
The example we used was NISA - News International Staff Association!
Murdoch's world may be crumbling but our laws still need amending.

Keith Ewing.jpgKeith Ewing points out that the reactionary strike laws
proposed by Cable, fail to deal with any of the underlying problems causing
industrial unrest in the UK. Cable's proposals followed  strike action by
the RMT in support of two victimised members, who have since won their ET
case against London Underground. If the UK had laws that protected trade
unionists from victimisation at work those strikes could have been avoided.
Ewing calls for UK victimisation laws to be updated in line with
international obligations.

Keith goes on to consider the proposed changes to balloting provisions
raised in Cable's speech, noting that similar laws have been operating in
Bulgaria since 1990. Those laws were condemned by the ILO Committee of
Experts in 1999 and the Bulgarian government was urged to amend its laws to
bring them into closer conformity with the principles of freedom of
