Access to justice in employment disputes: surveying the terrain
The Institute of Employment Rights, the thinktank for the labour movement,
has announced the launch of its much-anticipated publication

Coalition's employment tribunal reforms. The book goes on presale today (18
April 2013) and will be published on May 1st, when workers around the world
celebrate May Day.

ying-terrain> Access to justice in employment disputes: surveying the
terrain brings together the voices and ideas of some of the UK's top experts
in labour law, including John Hendy QC, Chair of the IER and go-to lawyer
for all major trade union cases; and Professor Linda Dickens MBE, Emeritus
Professor of Industrial Relations at the University of Warwick and
Independent Member of Acas. The publication consists of five papers, one
penned by Hendy and four by fellow lawyers, academics and experienced
mediators.
The publication is being launched as part of an ongoing project by editors
Nicole Busby, Director of the Centre of Employment and Labour Law Studies at
Strathclyde University; Dr Morag McDermont of the University of Bristol Law
School; and sociologists Dr Emily Rose and Adam Sales. This project, New
Sites of Legal Consciousness: Citizens Advice Bureaux (CAB) and Employment
Disputes, began in April 2012 and will run for two and a half years. It is
funded by the European Research Council and focuses on how clients of the
CAB make decisions as to whether to pursue a dispute through an employment
tribunal, choose an alternative option, or take no action at all.
During 2010/11, the CAB advised on 500,000 employment issues, and many of
these clients are likely to have used this free service because they are not
represented by trade unions and do not have the resources to access private
legal help and guidance - the very group the Coalition's reforms to Legal
Aid and Employment Tribunals will hit the hardest.
"Collectively, the papers represent a cohesive and compelling argument
against the current law and policy reform agenda, at least for those of us
concerned with the vital issues of access to justice for all workers and in
particular those without adequate resources - both financial and in terms of
other forms of social and economic capital - to utilise the current
provisions effectively," the editors said.
The team also provide recommendations for future steps, in terms of
research, policy changes and grassroots action.
